Shared owners may not be charged for amenities that they cannot access

On 30th June, Notting Hill Home Ownership (NHHO) lost its appeal to pass service charges on to shared owners at a block in Battersea for amenities provided to private homeowners on the development.  Although NHHO had entered into a lease that required it to contribute towards the costs of services provided across the whole scheme, the Upper Tribunal agreed with the findings of the First Tier Tribunal in July 2025 that shared owners could not be charged for services such as a gym, concierge and communal gardens that they could not access.
