Courts may grant RPs permission to force entry to rented homes to carry out gas or electrical safety checks

This will require certain conditions to be met and for landlords to make a written submission.  On 13th July, following a hearing at Southampton County Court, Judge Glen allowed an application by Stonewater to vary an injunction that required a resident to grant the organisation access to their home to carry out an electrical inspection.  This followed multiple unsuccessful attempts to gain access after an earlier application to force entry had been refused.  The judge inferred that the tenant was not present rather than actively opposing access.  He suggested some changes to tenancy agreements that would permit an RP to enter a property without notice in an “emergency” without needing to get authority from the Court.
